Terms of Service

1. Acceptance of Terms

By accessing or using iBeryl, you agree to be bound by these Terms of Service. If you do not agree, you must not use the platform. These Terms, together with our Privacy Policy, form the entire agreement between you and iBeryl.

2. Eligibility

You must be at least 18 years old to use iBeryl. By creating an account, you represent and warrant that you meet this age requirement. iBeryl reserves the right to request proof of age and to terminate accounts that do not comply.

3. Account and Verification

To use iBeryl, you must create an account and submit a verification photo. This photo is used to confirm you are a real person and to help maintain platform safety. You acknowledge that your verification photo will be stored as described in our Privacy Policy.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. Self-Declared Gender and Feature Eligibility

During registration, you self-declare your gender. iBeryl does not verify gender identity. Your self-declared gender determines access to certain features, including Room creation privileges for women. This is a feature eligibility and pricing structure — not a judgment on identity.

Deliberately misrepresenting your gender to gain access to restricted features constitutes a violation of these Terms and may result in account suspension or termination.

5. Rooms and Speed-Dating

iBeryl provides themed video Rooms where users participate in short video dates. Rooms may be created by iBeryl (public events) or by eligible users (women with an active subscription or sufficient Essence credits).

Room availability, capacity, and themes may vary and are subject to change. Current limits and features are displayed in-app where possible.

6. Freemium Model, Pricing, and Payments

iBeryl operates on a freemium model. Free users have limited access (e.g., up to 1 public Room per month). Additional access is available through:

• Subscription — $15/month, which includes unlimited Room access, Room creation for women, priority access, premium features, and HD quality.
• Essence — a one-time credit system (100 EXS = $1) for pay-per-use access to Rooms and features.

Subscriptions auto-renew unless cancelled before the end of the current billing period. You may cancel at any time and retain access until the end of your paid period. Pricing and feature limits may change; we will provide reasonable notice of material changes.

7. Code of Conduct

You agree to the following when using iBeryl:

• Treat all users with respect and courtesy.
• Do not engage in harassment, hate speech, threats, or intimidation.
• Zero tolerance for nudity and explicit sexual conduct — any violation will result in immediate and permanent account termination.
• Do not use the platform for commercial solicitation, spam, or fraud.
• Do not attempt to record, screenshot, or redistribute content from video dates without consent.

8. Reporting and Moderation

You may report any user who violates these Terms or makes you feel unsafe. Reporting a user automatically blocks them from being matched with you again. Our moderation team reviews all reports and may take action including warnings, restrictions, or permanent bans.

When you submit a report, iBeryl may capture and retain a limited amount of contextual content for the purpose of investigating and resolving the report. This may include the most recent 200 chat messages from the relevant session and a one-time screenshot of each participant's video frame where technically feasible. These materials are used solely for moderation, investigation, and enforcement of these Terms and are accessible only to authorized moderation personnel. iBeryl reserves the right to suspend or terminate any account at its discretion for violations of these Terms or conduct deemed harmful to the community.

9. No Recordings, No Stored Conversations

iBeryl does not record video or audio calls and does not store retrievable chat history. Transient technical processing may occur during call delivery for service quality and security purposes.

Exception for reports: to support legitimate safety and moderation activities, iBeryl may retain report-related chat excerpts and images as described in our Privacy Policy.

10. Intellectual Property

All content, design, branding, and technology on the iBeryl platform are owned by or licensed to iBeryl. You may not copy, modify, distribute, or create derivative works from any part of the platform without prior written consent.

11. Disclaimer of Warranties

iBeryl is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted access, error-free operation, or specific outcomes from using the platform.

12. Limitation of Liability

To the maximum extent permitted by applicable law, iBeryl and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the platform.

13. Indemnification

You agree to indemnify and hold harmless iBeryl, its operator, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution

These Terms are governed by the laws of France. Any disputes arising from these Terms or your use of iBeryl shall be subject to the exclusive jurisdiction of the courts of Montpellier, France, except where mandatory consumer protection laws require otherwise.

Arbitration and class action waiver (non-EEA/UK/CH users): For users outside the EEA, UK, and Switzerland, you agree that any dispute shall be resolved through binding individual arbitration rather than in court, and you waive any right to participate in class actions. This does not apply to disputes involving sexual assault or sexual harassment claims, which may be brought in court at the claimant's election as required by U.S. federal law.

15. Termination

You may delete your account at any time through the platform. iBeryl may suspend or terminate your account immediately and without notice for violation of these Terms, particularly for nudity, explicit sexual conduct, harassment, or fraud.

Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and dispute resolution) shall remain in effect.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email. Continued use of iBeryl after changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the platform.
